DTSC Treated Wood Waste Legislation Update

MESSAGE FROM JOHN KENNEDY Legislative Advocate with Rural County Representatives of California. 

Hello all.  I wanted to give you a head’s up that Assembly Member Quirk, Chair of the Assembly Environmental Safety and Toxic Materials Committee, introduced AB 332 today.  

AB 332 is an ESTM Committee bill that seeks to extend the treated wood waste regulations and contains a 2/3 urgency clause so the bill would go into effect immediately upon signature by the Governor.  While the bill contains an urgency clause, it will still take several months for the bill to work its way through the Legislature and (hopefully) get to the Governor’s desk.  My (unofficial) best and most optimistic guess that this occurs sometime in the July-August timeframe.

Please keep in mind that this measure is very much a work in progress and is nearly guaranteed to change significantly through the Legislative process as the Chair, Committee, stakeholders, and DTSC hammer out a long-term solution to the TWW management issue.  

I believe DTSC should be releasing more information of the variance process and application fees in the next week or so as part of the short-term bridge solution.

Kudos to Kathy Lynch for doing so much work on the bill and the issue.
